These Terms of Service ("Terms") govern your use of the Obsero website, hardware devices, software platform, and associated services (the "Services") provided by Obsero Pty Ltd ("Obsero", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. Purpose of the Services

Obsero provides remote monitoring and reporting technology designed to support pest management, environmental monitoring, research, and biosecurity programs. The Services enable customers to collect, review, manage, and report field observations in a structured and traceable manner.

2. Accounts and Authorised Use

You are responsible for maintaining the confidentiality of account credentials and ensuring that all authorised users comply with these Terms.

3. Deployment of Monitoring Devices

Customers are responsible for ensuring devices are deployed lawfully and with appropriate permissions. Obsero devices are intended for environmental and pest monitoring and must not be used for unlawful surveillance or activities unrelated to their intended purpose.

4. Customer Data Ownership

Customers retain ownership of all site-specific data collected through deployed devices, including images, classifications, and associated metadata ("Customer Data"). Obsero does not claim ownership of Customer Data.

You grant Obsero a non-exclusive licence to host, process, transmit, and analyse Customer Data solely for the purpose of providing and improving the Services.

5. Derived and Aggregated Information

Obsero may generate anonymised, aggregated, or statistical information derived from operation of the Services ("Derived Data"), provided such information does not identify individual customers, properties, or deployment locations.

The Services may include features designed to support traceability, auditability, and verification of monitoring activities, including time-stamped records, device identification, and structured reporting outputs. These functions are intended to assist customers in demonstrating monitoring activity and compliance with internal, regulatory, or program requirements.

Obsero may provide automated reporting tools to assist customers in preparing operational or regulatory documentation. Customers remain responsible for determining whether such reports meet their specific legal or compliance obligations.

Service performance may depend on third-party infrastructure including mobile networks, cloud services, and environmental conditions. Obsero does not guarantee uninterrupted availability but will take reasonable steps to maintain reliability.

10. Intellectual Property

All software, system architecture, analytics frameworks, and platform functionality remain the intellectual property of Obsero. These Terms do not grant rights to copy, reproduce, or commercialise the Services beyond their intended use.

11. Limitation of Liability

To the extent permitted by law, Obsero is not liable for indirect or consequential loss arising from use of the Services, including operational decisions made using monitoring data. Liability is limited to resupply of Services as required under Australian Consumer Law.

12. Changes to the Services or Terms

Obsero may update the Services or these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia.
